1. Scope

This policy applies to personal information handled in connection with the AUD Fund website, expressions of interest, investor communications, eligibility checks and potential investment opportunities.

The relevant issuer, AFS licensee, trustee, custodian, administrator or service provider may have its own privacy policy. Where you deal with those entities, their policies may also apply.

2. Information we may collect

Depending on your interaction, we may collect:

• name, email, telephone number, address and communication preferences;
• investor category, indicative investment range and strategy interests;
• information used to assess wholesale-client status, identity, source of funds, anti-money-laundering and sanctions requirements;
• professional, company, trust or family-office information;
• communications, meeting notes, enquiries and documents you provide;
• website technical data such as device, browser, IP address, referral source and page interactions if analytics or security tools are enabled.

3. How information may be used

Personal information may be used to:

• respond to enquiries and provide requested general information;
• assess whether you may be eligible to receive an offer or financial service;
• provide Information Memoranda, project updates and investor communications where lawful;
• conduct identity, wholesale-client, anti-money-laundering, source-of-funds, sanctions and fraud checks;
• consider, process and administer an application or investment;
• manage legal, tax, accounting, audit, reporting and regulatory obligations;
• protect systems, investigate misuse and improve website functionality;
• maintain records and manage complaints or disputes.

We do not intend to sell personal information to unrelated third parties.

4. Disclosure to other parties

Information may be disclosed where reasonably necessary to:

• AUD Group entities involved in project origination, development, design, construction, finance, management, leasing or sales;
• the relevant issuer, AFS licensee, authorised representative, trustee, custodian, administrator, financier or investment manager;
• lawyers, accountants, auditors, valuers, quantity surveyors, consultants, technology providers and document or data-room providers;
• identity-verification, AML/CTF, sanctions-screening, fraud-prevention and cybersecurity providers;
• government agencies, courts, regulators, law-enforcement bodies or other persons where required or permitted by law;
• a prospective buyer, financier or restructuring party in connection with a corporate or project transaction, subject to appropriate confidentiality controls.

Some service providers may store or process information outside Australia. Where practical, reasonable steps should be taken to understand and manage those arrangements.

5. Storage, security and retention

Reasonable administrative, technical and physical safeguards should be used to protect personal information. However, no email, website, cloud platform or data transmission is completely secure.

Personal information should be retained only for as long as reasonably required for the purpose collected, legal obligations, recordkeeping, dispute management and legitimate business needs, then securely deleted or de-identified where appropriate.

Never transfer investment money using bank details received only by email. Independently verify payment instructions using a trusted telephone number and the relevant legal documents.

6. Access, correction, marketing and complaints

You may request access to or correction of personal information held about you, subject to legal exceptions. You may also ask to stop receiving marketing communications.

If you believe personal information has been mishandled, contact us with sufficient details to investigate. A complaint may also be taken to the Office of the Australian Information Commissioner where applicable.

Cookies or analytics may be introduced when the site is deployed. A production deployment should display a suitable cookie notice and update this policy to identify the tools and choices available.
